Without breaking a beat, former House Speaker Newt Gingrich exposed the judiciary’s bias against President Trump and dismantled Judge Boasberg’s and other federal judges’ flawed reasoning. In an attempt to overrule President Trump’s recent executive orders, Mr. Gingrich rightly chastised judges of abusing their authority. He even exposed the judges for attempting to exercise power that was exclusively intended for the President.
For background, during a recent hearing of the House Judiciary Committee, Gingrich persuasively argued that President Trump’s recent executive orders were legal by using the 1798 Alien Enemies Act. Mr. Gingrich addressed birthright citizenship, the deportation of illegal immigrants, and a number of other significant topics that have polarized judges against President Trump.
In his opening remarks on April 1, Mr. Gingrich called attention to the extraordinary takeover of authority by Judge Boasberg and fifteen other District Judges. “In the first six weeks of the current presidency, fifteen District Judges effectively seized control of various Executive Branch duties through nationwide injunctions,” Mr. Gingrich stated matter-of-factly. This might be a coup d’etat in the legal system. It blatantly transgresses both the Constitution and over two centuries of American history.
“Unelected lower-court judges have been steadily grabbing power for years,” Mr. Gingrich added, refusing to back down. Vince Haley and I wrote “Bringing the Court Back under the Constitution” in 2012 because it was such a clear threat. I am submitting this historic (sic) study for the Record.
Mr. Gingrich continued by quoting the Harvard Law Review to support his claims. “From 2001 to 2023, District Courts issued 96 nationwide injunctions,” he added. Sixty-four percent of them were issued while President Trump was in office. Additionally, judges appointed by Democratic presidents issued 92% of the injunctions against President Trump.
Mr. Gingrich emphasized the startling 15 injunctions against the present Trump administration since January 20, 2025, as a way to emphasize his case. “The idea that unelected lawyers can micromanage the Executive Branch — and override a Commander in Chief who received 77.3 million votes — should trouble every American,” Gingrich remarked in reference to this power grab.
Mr. Gingrich persisted in his condemnation of Federal Judges such as Boasberg throughout his testimony. Gingrich used a number of instances from previous presidents who disregarded the Supreme Court while staying within their authority to demonstrate how unusual the judges’ actions are. Focusing on the details, Gingrich stated, “President Andrew Jackson and the Supreme Court were constantly at odds. The Dred Scott ruling, which expanded slavery, became a focal point of President Abraham Lincoln’s 1858 Senate campaign.
