Former House Speaker Newt Gingrich quickly disproved Judge Boasberg and other federal judges’ flawed arguments and highlighted the judiciary’s bias against President Trump. Mr. Gingrich correctly criticized judges of abusing their power to overturn President Trump’s executive actions and even exposed them for trying to utilize presidential power.
Gingrich testified at a House Judiciary Committee hearing that President Trump’s recent executive actions were legal under the 1798 Alien Enemies Act. Mr. Gingrich addressed immigration deportation, birthright citizenship, and other topics that have pitted judges against President Trump.
Mr. Gingrich began his April 1 hearing by highlighting fifteen District Judges’ enormous power grab, including Judge Boasberg. Mr. Gingrich stated, “Fifteen District Judges took over Executive Branch duties in the first six weeks of the current presidency through nationwide injunctions.” This might be a judicial coup. It defies the Constitution and 200 years of American history.”
Mr. Gingrich refused to back down, saying, “Unelected lower-court judges have been steadily grabbing power for years. This threat was so evident that Vince Haley and I wrote “Bringing the Court Back under the Constitution” in 2012. I’m submitting a history study for the Record.”
Mr. Gingrich cited Harvard Law Review to support his claims. From 2001 until 2023, District Courts issued 96 countrywide injunctions. Two-thirds (64), granted under Trump, Also, Democratic presidents appointed 92% of the judges who issued injunctions against Trump.
Mr. Gingrich emphasized the extraordinary 15 injunctions against the Trump administration since January 20, 2025. Gingrich added, “The notion that unelected lawyers can micromanage the Executive Branch — and override a Commander in Chief who received 77.3 million votes — should trouble every American.”
Mr. Gingrich continued to indict Federal Judges like Boasberg in his testimony. Gingrich highlighted many presidents who disobeyed the Supreme Court within their ability to demonstrate the judges’ unusual behavior. Specifically, Gingrich claimed, “President Andrew Jackson was in constant fights with the Supreme Court. The 1858 senatorial campaign of Abraham Lincoln focused on the Dred Scott decision increasing slavery.
